1. Acceptance of Terms

By accessing or using the Nudge platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Nudge is a Q&A marketplace that connects people who have questions ("Askers") with experts, creators, and professionals ("Creators") who provide paid answers. Creators set their own pricing and answer questions at their discretion.

3. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• One person may not maintain more than one account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Refunds

• All payments are processed through Stripe.
• When an Asker submits a question, their payment method is authorized but not charged until the Creator answers.
• If a Creator does not answer within the designated timeframe, the payment authorization expires and the Asker is not charged.
• Nudge charges a service fee on transactions. Current fee rates are displayed during the payment process.
• Creators receive payouts through Stripe Connect according to Stripe's payout schedule.
• Refunds are handled on a case-by-case basis. Contact us if you believe a refund is warranted.

5. Creator Responsibilities

• Creators must provide honest and good-faith answers to questions they choose to answer.
• Creators set their own prices and are responsible for the accuracy of their profile information.
• Creators must comply with all applicable laws and regulations, including tax obligations on their earnings.
• Creators must not use the platform to provide professional advice (legal, medical, financial) unless properly licensed.

6. Asker Responsibilities

• Askers must ask genuine questions and not use the platform for harassment, spam, or other abusive purposes.
• Answers received are for personal use. Askers must not publicly share or redistribute answers without the Creator's consent.
• Askers acknowledge that answers represent the Creator's personal opinions and are not professional advice.

7. Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or threaten other users
• Submit false, misleading, or fraudulent information
• Attempt to circumvent payment or platform fees
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or use automated means to access the Service without permission
• Impersonate another person or entity

8. Intellectual Property

Creators retain ownership of their answers. Askers receive a personal, non-transferable license to use the answers they receive. The Nudge name, logo, and platform design are the property of Nudge. You may not use our branding without written permission.

9. Disclaimers

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee the quality, accuracy, or completeness of any answers provided by Creators.
• Nudge is a platform that facilitates connections between Askers and Creators. We are not a party to the Q&A transaction itself.
• Answers on the platform do not constitute professional advice. Always consult a qualified professional for legal, medical, or financial decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Nudge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to Nudge in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.
